These terms govern your use of the scalinatasoftware.com website, operated by Scalinata Software inc., a Quebec (Canada) corporation (“we”). By using this site, you accept these terms. If you do not accept them, do not use scalinatasoftware.com.

1. The site

scalinatasoftware.com presents Scalinata Software inc. and our software and lets you write to us through a contact form. This site sells nothing and has no user accounts.

Each software product has its own website, its own terms of use and its own privacy policy. These terms govern this site only: they do not replace those of a product, which apply to its use, its account and its purchases.

2. Permitted use

You are responsible for the content you send us through the contact form. You must not send us content that is:

• unlawful, defamatory, abusive, threatening or harassing;
• infringing the rights of others (copyright, privacy), or containing another person's personal information without their consent;
• intended to make you pass for someone else;
• unsolicited and repetitive (spam), or containing a virus or any harmful code.

You must also not attempt to gain unauthorised access to the administrative part of the site or to its servers, disrupt its operation, bypass its protections or query it in an automated, massive way.

Your message is not published: only you and our authorised staff can access it. We do not monitor it in advance, but we may refuse or delete a message that breaches this article and, where the law requires it, pass it on to the authorities (see the privacy policy).

3. Intellectual property

The texts, the logo, the name “Scalinata Software”, the names of our products, the images and the design of this site belong to us or are used with the permission of their owner, and are protected by copyright and trademark law. You may view the site and quote short extracts with attribution; any other reproduction or use requires our prior written permission.

Each product is provided under a usage license: you do not acquire ownership of it, but a right to use it under the terms of the product concerned.

The messages and suggestions you send us are used to answer you and to improve our services. You authorise us to take them into account, without compensation; we publish neither your name nor your message.

4. Accuracy of the content

The descriptions of our software are given for information and are not a firm offer. The features, plans, prices and terms that apply to a product are those shown on that product's website at the time you use or buy it.

The content may contain errors. If you spot one, report it to us: we will correct it as soon as possible. You use the content at your own risk and, to the extent permitted by law, we are not liable for the consequences of an error, except in cases of gross or intentional fault and the mandatory consumer rights, which no clause of these terms can set aside.

5. Links to other sites

This site links to other sites, including those of our products (dicteo.app, zourou.app). A link to a site that is not ours is not an endorsement of its content: we do not control third-party sites and we are not responsible for their content or practices.

6. Availability and liability

• scalinatasoftware.com is provided “as is”, without warranty of any kind. We aim for continuous service, but we cannot promise it will be free of interruptions or errors. Content may be added, changed or withdrawn.
• To the extent permitted by law, we are not liable for indirect damages (loss of data, time, profits) arising from the use of this site or the inability to use it. As this site is free and sells nothing, our total liability to you in respect of it is limited to the amount you paid us in respect of it in the 12 months before the event, that is, zero dollars if you paid us nothing.
• Nothing in these terms excludes or limits our liability for gross or intentional fault, or the rights the law gives you as a consumer and that you cannot waive.

7. E-mails and personal data

We send no promotions and no newsletters. If you write to us, we reply and may follow up with you about your request, and only about it.

8. Changes to the terms

We may change these terms. For an important change, we notify you with at least 30 days' notice by a notice on the site. If you keep using this site after the change takes effect, you accept it; otherwise, stop using it. The date at the top of this page shows the version in force.

9. Governing law and disputes

These terms are governed by the laws of Quebec and the federal laws of Canada applicable therein. Any dispute falls under the competent courts of Quebec. If you are a consumer, this clause does not deprive you of the mandatory protections of the law of your country of residence, or of the right to go to the courts of your place of residence where the law guarantees it.

10. Miscellaneous

• If a provision of these terms is held invalid, the others remain in force.
• The parties have expressly required that these terms be drafted in French. This English version is a courtesy translation: in case of discrepancy, the French version prevails.
